Negotiations Update

March 18, 2024 - All TCRC Local Chairs – CPKC Eastern and Western Regions – Negotiations Bulletin 6

As everyone is aware, CPKC served Notice of Dispute and the Minister of Labour has appointed Conciliation Officers from Federal Mediation and Conciliation Services.

The Conciliation Officers have subsequently been in touch with both parties to set up dates for this process to start. Unfortunately, at this point, CPKC has only agreed to meeting in the West on March 26 and 27 and has not agreed to any other dates, regardless of the fact that they were the ones that served notice of dispute and sought assistance.

Regarding CPKC sending the incomplete package to the membership, the Union has filed a complaint with the Canadian Industrial Relations Board. The complaint, filed on March 14, 2024, reads in part:

The Employer’s decision to send a letter and documents to the Union’s membership represents an attempt to bargain directly with and to unduly influence employees. The Employer’s purpose in sending these communications was to undermine the viability of the Union in the eyes of its membership. This violation of the Code is only compounded by the presence of untruthful statements in the Employer’s communications, the inclusion of documents that differ in crucial respects from those actually exchanged by the parties and the omission of crucial information to the Union’s membership.

We will provide updates regarding the complaint as they are available. Regardless, we trust that everyone has had an opportunity to read through the Company’s “options 1 and 2” and have not been led astray by the smoke and mirrors. Also, hopefully you have taken the time to read the Union’s synopsis of same and have come to the same conclusion as your bargaining committee

As indicated in previous communications, the Union is currently arranging a strike vote which will begin April 8th. The process will be conducted electronically without a mail out portion. Therefore, the TCRC must have an email on record for you to receive a ballot.

We remind all members to ensure you have updated your full contact info (mailing address, email address, phone number) with your Division S/T who will compile and send it to the respective General S/T and/or National Office. Additionally, you can update your contact information through the TCRC App.

We remain committed to properly negotiating a Collective Agreement and will continue to vigorously advocate for and defend the members’ best interests.
